Veesual ("us", "we", or "our") operates the vidcap.ai and app.vidcap.ai website (the "Service"). This page informs you of our policies regarding the collection, use and disclosure of information when you use our Service.

"Personal data" refers to any information relating to an identifiable individual or his or her personal identity. It applies to the processing of personal data carried out on the Site and completes the Terms & Conditions that can be consulted by users.

We use the personal data submitted to us in accordance with Regulation (EU) 2016/679 of 27 April 2016 (the "GDPR") and the French Data Protection Act of 6 January 1978 (referred together as the "Applicable Regulation").

This Privacy Policy does not apply if you use the Service to process personal data in the context of your business activities. In this case, you are the data controller, and Vidcap is the data processor processing on your behalf.

If you are part of a subscription for multiple seats, or if you are a user who collects personal data about others through another Service, then Vidcap collects, uses, transfers, discloses and stores certain personal data on your behalf as a data processor in connection with your use of the Service. In those cases, our Data Processing Addendum applies. Our Data Processing Addendum sets out the specific personal data Vidcap collects and processing operations Vidcap performs on your behalf as a processor and is incorporated into these Terms. In the event of any conflict between these Terms and the Data Processing Addendum, the Data Processing Addendum shall prevail. Any categories or personal data or processing operations that are not set out in our Data Processing Addendum will be processed and protected by Vidcap as a data controller subject to and in accordance with Vidcap Privacy Policy.

1) Information we collect

  • Data you provide to us:
    • Civil identity, Account data, contract data, payment and billing information: collected when you subscribe to our Service;
    • Technical Data, Usage data: when you use our Service;
    • Input: when you import images in order to process the Service.
  • Data generated when you use the Service:
    • Output data: when we generate content on your behalf.

2) Process of personal data

We use the information we collect about you for the purposes set out below:

  • General administration and access to the service (management of identifiers, teams): in order to perform the Service;
  • Manage the commercial relationship (billing, customer service): in order to perform the contract;
  • Generate videos: in order to perform the contract;

3) Duration of Personal Data Retention

Following termination or deactivation of your user account, We will retain your profile information and User Content for a commercially reasonable time, and for as long as we have a valid purpose to do so. In particular, Vidcap will retain your information for the purpose of complying with its legal and audit obligations, and for backup and archival purposes.

4) Information collection sharing

We may share your personal data on a need-to-know basis with the following parties:

  • Our Team Members. Authorized members of our teams who need to access your personal data, strictly to perform their jobs;
  • Financial Institutions. Banks and other financial organizations;
  • Regulatory Authorities. Such as the French data protection authority (CNIL);
  • Legal and Professional services. When appropriate, we may share data with competent courts, mediators, accountants, auditors, lawyers, bailiffs, and debt collection agencies.
  • Additionally, we may share all or part of your personal data with our service providers.

Before engaging with any provider which handles customer data, our security team conducts audits to ensure they meet our privacy and security standards, in accordance with our certifications. We sign a dedicated data protection agreement with each of these providers.

5) Your rights

Under data protection laws, you have several rights regarding your personal data:

  • Access: You can request access to your personal data to understand how it is processed and to obtain a copy of the data.
  • Rectification: You have the right to have any outdated, incorrect, or incomplete personal data corrected.

We will take every step to make sure we reply to your requests. However, when your request concerns the training of our models, it's important to note that your rights have technical limitations and fulfilling your requests might involve a complex technical process.
